The Abuja Division of the Court of Appeal will today delivers it judgment on the appeal brought by Comrade Daniel Onjeh, the APC candidate in the 2023 senatorial election for Benue South. Onjeh is contesting the declaration of Senator Abba Moro of the PDP as the winner of the election in Benue South.
The Court of Appeal had previously heard Onjeh’s appeal on Monday, October 16, during which all arguments and briefs were presented and adopted. Subsequently, the matter was reserved for judgment.
Comrade Onjeh’s appeal is primarily centered on his quest to be declared the true winner of the Benue South 2023 Senatorial Election.
He argues that Sen. Moro, the first respondent, was not qualified to contest the election due to the alleged presentation of a forged birth certificate to INEC.
Onjeh challenges the election’s outcome on the grounds of noncompliance with the Electoral Act 2022 (As Amended) and cites other irregularities. He requests the court to declare all votes allocated to Sen.
Moro in the election as wasted votes, and subsequently declare himself, the first runner-up, as the true victor.
Onjeh contends that if the court nullifies the unlawful votes attributed to Sen. Moro due to noncompliance and irregularities, and re-evaluates the election results, it will demonstrate that he, not Sen. Moro, received the highest number of valid votes in the election.
