Apa/Agatu: Adama ‘Otalaka’ emerges victorious as court throws out Godday Adagboyi’s objection
The Federal High Court presided by Justice Emeka Nwite, sitting in Abuja on Tuesday, struck out an objection filed by the duo of Hon. Godday Odagboyi Samuel and the APC.
The court ruled in favor of Hon. Joseph Adama Joseph.
In a 40-minute ruling, the court held that all the objections raised by Godday Samuel and the APC lacked merit and were baseless.
The court upheld the legal arguments of the Plaintiff, Hon Adama Joseph Adama and all his prayers contained in his motion were granted.
In the ruling, the court also made some pronouncements bordering on the substantive case which recognized the result of the APC primary election held on the 28th May, 2022 in which Hon Adama Joseph ADAMA polled over 18,000 votes to defeat the incumbent House of Rep member, Hon. Godday Samuel who came second with about 3,000 votes.
In line with the court documents, the only reasonable objections raised in court by Godday Samuel and the APC is the omission of letter “S” from the name of the “ALL PROGRESSIVES CONGRESS”. The “PROGRESSIVES” was erroneously written as “PROGRESSIVE” with an omission of Letter “S”.
The court held that the objections were baseless and lacked merit. The court held that the error of spelling was a mere misnomer which had since been corrected by the lawyers of Adama Joseph ADAMA.
Reacting, Otache said, “With today’s court ruling by Justice Nwite of Court 8 of the Federal High Court, the APC House of Representatives ticket for Apa/Agatu Constituency ultimately belongs to Hon. Adama Joseph ADAMA.”
It would be recalled that Hon. Adama Joseph ADAMA popularly known as OTALAKA won the APC primary election for the Apa/Agatu Federal Constituency which was conducted on the 28th May, 2022 but the name of the incumbent House of Rep member for Apa/Agatu Constituency, Hon. Godday Samuel Odagboyi was rather sent to the INEC and this made the winner of the APC Primary election, Hon Adama Joseph ADAMA to institute a lawsuit at the Federal High Court, Abuja in suit no.FHC/ABJ/CS/862/2022, before Honorable Justice Emeka Nwite.
The suit was filed and prosecuted at the Federal High Court on behalf of Hon. Adama Joseph ADAMA by a team of young lawyers led by Barr. Patrick Okoh and Barr. Napoleon Otache.
Barrister NAPOLEON OTACHE equally hinted that just like it is not possible for human hands to have the capacity of covering the face of the sun to prevent it from shining, in a similar vein, justice cannot be suppressed.
Barrister NAPOLEON OTACHE advised all the stakeholders to put the interest of the party and the people of Apa and Agatu above any personal interest.
