The Court of Appeal in Abuja has sacked Musa Ilyasu Kwankwaso, a member of the All Progressives Congress, from his position and reinstated Yusuf Umar Datti, representing the New Nigeria People’s Party, in the Kura/Madobi/Garun Malam Federal Constituency Election.
This ruling was made by a three-panel committee led by Justice Tunde Oyebamiji Awotoye.
The committee permitted an appeal by Yusuf Datti and concluded that the earlier tribunal’s judgment was erroneous in counting the date of the appellant’s resignation as the date of his party’s primary election.
The court ruled that Section 77 of the Electoral Act had been misapplied in the previous judgment, with the court asserting that no court possesses the jurisdiction to rule on matters related to party membership.
