The Court of Appeal sitting in Lagos State has issued a ruling that resulted in the removal of Denis Agbo, a member elected on the platform of the Labour Party, representing the Udenu/Igboeze North federal constituency in Enugu State. The court’s decision, delivered via Zoom on Friday, has mandated a fresh election within 90 days for all parties involved.
The judgment followed an appeal by Dr. Oby Ajih, the All Progressives Congress (APC) candidate, who contested the previous election. Dr. Ajih challenged the ruling of the tribunal, asserting that the election did not follow the correct process, primarily because the logo of her party was not included in the EC8A form.
In a judgment that lasted less than 30 minutes, the Court of Appeal agreed that the appeal had merit and set aside the tribunal’s judgment. The court ruled that the non-inclusion of the APC’s logo in the result sheet (form EC8A) was not in compliance with the electoral act.
As a result, the Independent National Electoral Commission (INEC) has been directed to conduct a fresh election within the specified timeframe, providing an opportunity for a new electoral process in the Udenu/Igboeze North federal constituency of Enugu State.
