Appeal Court upholds Abba Moro’s election, throws out Onjeh’s appeal
The Appeal Court in Abuja in Wednesday threw out the suit brought before it by the All Progressives Congress candidate in the last senatorial election in Benue South, Dan Onjeh against the election of Senator Abba Moro.
The National Assembly Election Petition Tribunal had upheld the election of Senator Moro over Onjeh’s failure to prove his case beyond reasonable doubt.
Not satisfied by the judgement, Onjeh approached the appellant court to upturn the verdict of the lower court and declare him winner of the election.
Giving his verdict on Wednesday on behalf of the three-man panel, the court held that Onjeh did not win the election as claimed.
The court also said Onjeh could not prove his claim that Senator Moro forged his birth certificate, saying that “he who asserts must prove.”
His case was struck out.
