The State Legal Adviser of the All Progressives Congress, APC, Matthew Alyebo Esq, took decisive actions today by moving a Makurdi High Court to strike out two suites, MHC/04/2024 Hon. Moses Agaba v. Augustine Agada and APC, and MHC/62/2024 Hon. Benjamin Omakolo v. APC.
The motion was grounded on the basis of want of diligence in pursuing the cases on the part of the appellants.
During proceedings today, it was noted that learned silk, JJ Usman SAN, representing the plaintiffs was conspicuously absent from the courtroom without any prior correspondence explaining his absence. Consequently, Justice Polycarp Kwahar presiding over the case concurred with the APC Counsel’s argument, that the plaintiffs had sufficiently abandoned their cases due to their lack of diligence.
As a consequence of the court’s ruling, both cases were promptly struck out, marking a significant victory for the Benue State APC and its legal representation.
Recall that Hon. Moses Agaba and Benjamin Omakolo had in separate suits dragged Comrade Austin Agada to court challenging his legitimacy as Chairman of the APC in Benue State. Agaba would later secure an interim injunction restraining Comrade Agada from parading himself as Chairman which was later vacated by a Benue State High Court sitting in Makurdi on the 12th February 2024.
The state Chief Judge, Maurice Ikpambese while vacating the injunction against Agada stated that the restraining order was granted in error, and in furtherance declared all actions taken on the matter including appointment of Hon. Omakolo as acting State Chairman null and void.
