BREAKING: Supreme Court slaps Mike Ozekhome with N40m fine over frivolous motion

The Supreme Court has imposed a fine of N40 million on Senior Advocate of Nigeria, Mike Ozekhome, for submitting a frivolous, vexatious, and irritating motion concerning the 2019 Imo State governorship.

The court dismissed an application by Emeka Ihedioha of the Peoples Democratic Party (PDP) seeking a certificate of return as the rightful governor of Imo state. Ozekhome, Ihedioha’s lawyer, was penalized for filing a motion to revalidate the suit that removed him as governor in 2019.

Justice Tijani Abubakar ordered Ozekhome to personally pay the N40 million fine to four respondents: the Action People’s Party (APP), Uche Nnadi, Uche Nwosu, and the Independent National Electoral Commission (INEC).

The motion, deemed frivolous by the court, sought a consequential order compelling INEC to issue a fresh Certificate of Return to Ihedioha, alleging that the incumbent governor, Hope Uzodinma, unlawfully occupied the four-year tenure meant for Mr Ihedioha.

The court dismissed the motion, citing lack of jurisdiction and characterizing it as strange, frivolous, baseless, unwarranted, vexatious, and irritating.
