Rt. Hon. Herman Hembe, the gubernatorial candidate of the Labour Party in Benue State in the 2023 general elections has lost his suit against the Benue Chapter of the All Progressive Congress, APC, and the Independent National Electoral Commission, INEC.
Recall that the APC and INEC published Hembe’s name amongst the list of gubernatorial candidates of the APC.
The House of Representatives member cum guber candidate however filed a suit challenging the APC and INEC refuting the claim that he was a member of the party.
However, a Federal high court sitting in Makurdi on Monday October 31st struck out the case filed by Hembe against the APC and the Independent National Electoral Commission, INEC, for wrongfully including his name in the APC result sheet even after he had left the party.
Hembe has however reacted to the development, below is the excerpt of his reaction to the court judgement;
“Good evening.
Today, a Federal high court sitting in Makurdi struck out a case I filed vs. the APC and INEC for wrongfully including me in their result sheet even after I had left the party.
The court in its wisdom held that the matter wasn’t properly addressed before the court and thus declined jurisdiction.
I have accepted the ruling and in many ways, agree with it.
The matter was about me seeking 500 million Naira in damages vs. APC for the embarrassment they caused me by including me on their result sheet. It has nothing to do with my membership of APC or any other political party for that matter. In any case, the court refused to delve into the substance of the matter and struck it out for lack of jurisdiction.
I take pride that the state APC Chairman still desires to have me as their member. I appreciate that. However my ship has sailed from the murky waters of KM4, I have taken my place at the head of the labour movement in Benue that from small beginnings, is gaining traction and waxing stronger.
I hope that as these judgments continue to come forth, the APC will also be bold enough to accept their outcomes, what ever they are and not delve into insulting the courts in the manner they have attacked and insulted my Lord Bishops for not encouraging their candidates contumacy.
