A 10-year-old boy has been convicted for culpable homicide by a high court sitting in the Gumel Local Government Area of Jigawa State.
The court presided over by Justice A. M. Sambo, said the offence is contrary to Section 221(b) of the Penal Code Law of Jigawa State.
The prosecution led evidence and established the fact that the defendant took his three-year-old nephew (name withheld) from his grandmother’s house to his mother’s home, Daily Post reports.
According to the prosecution, “on their way, the defendant kept his nephew under a tree to fetch some grasses in a nearby bush, but the deceased started crying which upset the defendant. He, therefore, strangled the deceased until he died.
“The defendant subsequently dug a shallow grave and buried the 3-year-old boy.”
He said the defendant was interrogated by the parents of the deceased on their son’s whereabouts until the next day when the defendant led the deceased’s father, their ward head, the police and some people to the place where he had buried the deceased.
The body of the deceased was exhumed and taken to a General hospital in Gumel for medical examination.
The defendant was convicted on Thursday by Justice Sambo.
The judge ordered the convict to be kept at Kafin Hausa reformatory centre at the governor’s pleasure.
