How to extend Canadian work permits sans LMIA or CAQ

Many foreign workers may not be aware that they can apply to extend their expiring work permits even without having received their new Labour Market Impact Assessment (LMIA) and a new Certificat d’Acceptation du Quebec/Quebec Acceptance Certificate (CAQ), if required.

LMIA and CAQ are both documents necessary for foreign workers to work in Canada. LMIA is an application submitted by Canadian employers in the Temporary Foreign Worker Program to show that hiring a foreign worker will not negatively affect the Canadian labor market. CAQ, on the other hand, is provided by the Government of Quebec to foreign workers, allowing them to secure their work permits in Quebec.

To extend a work permit without the new LMIA and CAQ, applicants must ensure to provide proof of a valid job offer and evidence that they have requested the LMIA and CAQ. This can be done by uploading copies of the application submissions, receipt confirmation numbers, or by indicating relevant details in the work permit application.

Once the new LMIA and CAQ, if applicable, are received, proof must be sent to the immigration department within 60 days of the initial work permit application submission to avoid refusal.

Consulting with an immigration lawyer may be beneficial for those whose work permits are expiring soon and need guidance through the extension process, ensuring all necessary proof and documents are provided.
