The DOS has introduced a pilot program, set to run from January 29, 2024, to April 1, 2024, allowing eligible Indian and Canadian nationals to renew their H-1B nonimmigrant visas within the United States. The initiative aims to expedite the renewal process by eliminating the need for an in-person consular interview.
Reinstating Domestic Renewals
Since 2004, the DOS suspended the domestic renewal of non-diplomatic visas due to enhanced requirements under the Enhanced Border Security and Visa Entry Reform Act of 2002. This act mandated the inclusion of biometric identifiers in U.S. visas issued after October 26, 2004. With advancements in technology, the DOS is reintroducing the domestic renewal process for specific nonimmigrant classifications, starting with the H-1B visa.
Eligibility Criteria
To participate in the pilot program, applicants must meet specific criteria, including having a prior H-1B visa issued by the U.S. Mission Canada or U.S. Mission India within specific issuance date ranges. Other requirements include exemption from the nonimmigrant visa issuance fee, eligibility for a waiver of the in-person consular interview, and an approved and unexpired H-1B petition.
Application Process and Timeline
Applicants can submit their applications online through the dedicated domestic visa renewal website from January 29, 2024. The DOS will release approximately 2,000 application slots per week, alternating between those whose most recent H-1B visas were issued by Mission Canada and Mission India.
The processing time is estimated to be six to eight weeks, with the DOS aiming to complete all applications by May 1, 2024. It’s crucial to adhere to the application dates, as the online portal will be locked once the weekly limit is reached.
Required Documentation
